Loyalty Program Terms and Conditions

Effective Date: January 1, 2026

These Terms and Conditions (“Terms”) govern participation in the Abbott’s Frozen Custard Loyalty Program (“Program”). By enrolling in or participating in the Program, you agree to these Terms.

1. Eligibility

The Program is open to any individual customer who provides a valid mobile telephone number to Abbott’s Frozen Custard (“Abbott’s”). Participation is limited to natural persons and is intended for personal, non-commercial use.

Abbott’s reserves the right to deny, suspend, or terminate participation in the Program at its sole discretion.

2. Enrollment

Customers are automatically enrolled in the Program upon providing their mobile phone number to Abbott’s and agreeing to these Terms.

Customers are responsible for providing accurate and current contact information. Abbott’s is not responsible for any lost rewards or Program communications resulting from inaccurate or outdated information.

3. Earning Points

Members earn one (1) loyalty point for every one U.S. dollar ($1.00) spent on eligible purchases at participating Abbott’s Frozen Custard locations.

Points are awarded based on the final purchase amount after discounts, promotions, coupons, refunds, taxes, and other exclusions as determined by Abbott’s.

Points have no cash value and may not be transferred, sold, assigned, or exchanged.

4. Redeeming Points

Points may be redeemed toward eligible purchases at a current redemption value of $0.10 per point.

Abbott’s reserves the right to change the redemption value, modify redemption requirements, limit redemption options, or impose additional restrictions at any time without prior notice.

Points are not redeemable for cash except where required by law.

5. Program Changes and Termination

Abbott’s may modify, suspend, discontinue, or terminate the Program, in whole or in part, at any time and for any reason, with or without notice.

Abbott’s may change:

Point earning rates;

Redemption values;

Program benefits;

Eligibility requirements;

Participating locations; and

Any other aspect of the Program.

If the Program is terminated, any accumulated points may be forfeited unless otherwise required by applicable law.

6. Returns and Adjustments

If a purchase for which points were awarded is returned, refunded, canceled, or otherwise adjusted, Abbott’s may deduct the corresponding points from the member’s account.

Abbott’s reserves the right to correct any errors related to point balances or rewards.

7. Text Messaging Consent

By providing your mobile phone number and participating in the Program, you expressly consent to receive recurring text messages from Abbott’s regarding:

Loyalty Program participation;

Point balances and rewards;

Promotional offers;

Marketing communications; and

Other information related to Abbott’s products, services, and events.

Message frequency may vary. Message and data rates may apply according to your mobile carrier’s plan.

Consent to receive text messages is not required to make a purchase. You may opt out of marketing text messages at any time by following the unsubscribe instructions provided in the message, such as replying “STOP” where applicable.

8. Privacy

Information collected in connection with the Program, including mobile phone numbers and purchase history, may be used by Abbott’s to administer the Program, provide rewards, communicate with members, and send promotional and marketing messages, subject to Abbott’s Privacy Policy.

9. Abuse and Fraud

Abbott’s may revoke membership, cancel points, or terminate participation if it believes a member has:

Violated these Terms;

Engaged in fraud or abuse;

Provided false information; or

Attempted to manipulate the Program in any way.

Abbott’s decisions regarding Program operation, point balances, and eligibility are final.

10. Limitation of Liability

To the fullest extent permitted by law, Abbott’s shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the Program, including any loss of points, rewards, or Program benefits.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state in which the participating Abbott’s location is located, without regard to conflict of law principles.
